WAIVER AND RELEASE OF LIABILITY
RunnerX LLP
DEFINITION OF EVENT
For the purposes of this Waiver, the term “Event” shall mean any event organised, conducted, managed, or facilitated by RunnerX LLP, including but not limited to running events such as Jodhpur Marathon, Udaipur Marathon, Kota Half Marathon, and any other present or future events conducted under the RunnerX platform, whether conducted physically or virtually, together with all associated activities, programs, services, and arrangements connected thereto.
ON-GROUND EVENT WAIVER
I, for myself and/or on behalf of my ward (where applicable), hereby declare, acknowledge, confirm and irrevocably agree as follows:
1. I confirm that all information provided by me in the registration process is true, complete, and accurate, and I accept full responsibility for the correctness of such information, whether submitted for myself or for my ward or any other participant registered by me.
2. I understand and agree that I/my ward shall participate only on the route designated by the Event organiser and shall not deviate from the approved course unless instructed by event officials.
3. I agree to abide by all Event rules, instructions, and guidelines issued by RunnerX LLP or event officials, and understand that failure to comply may result in disqualification without refund.
4. I acknowledge that the Event may be conducted on public roads or open environments and may involve risks arising from traffic movement, road and surface conditions, weather conditions including extreme heat, physical exertion, crowd density, negligence of other participants, and any other unforeseen circumstances, and I accept full responsibility for all such risks.
5. I confirm that I/my ward is medically fit, adequately trained, and physically capable of participating in the Event, and that no medical condition exists which may be aggravated by participation, and that I have obtained appropriate medical advice where necessary.
6. I fully understand and acknowledge that participation in the Event is an endurance and/or physical activity which involves inherent risks, including but not limited to serious physical injury, permanent disability, or death, and I
voluntarily and unconditionally assume all such risks on behalf of myself and/or my ward.
7. I understand that RunnerX LLP does not conduct any medical examination and is under no obligation to provide medical supervision, and in the event of any injury or illness to me/my ward, I authorise the event officials, at their discretion, to arrange medical assistance, transportation, or treatment, and I agree that all such actions shall be at my sole risk and cost, and I further agree to bear and reimburse all expenses incurred and waive any claim arising out of any delay, deficiency, or inadequacy in such medical assistance.
8. I hereby irrevocably waive, release, discharge, and covenant not to sue RunnerX LLP, its partners, designated partners, directors, officers, employees, agents, sponsors, volunteers, event officials, venue owners, government authorities, and all other persons or entities associated directly or indirectly with the Event, from any and all claims, demands, liabilities, actions, causes of action, damages, losses, costs, or expenses of any nature whatsoever, whether arising in contract, tort (including negligence), strict liability, or otherwise, including but not limited to any injury, illness, disability, death, or loss of property suffered by me/my ward before, during, or after participation in the Event.
9. I further agree to indemnify, defend, and hold harmless RunnerX LLP and all associated entities from and against any claims, liabilities, damages, costs, or expenses arising out of or in connection with participation by me/my ward or any breach of this Waiver.
10. I acknowledge and agree that the Event may be cancelled, postponed, rescheduled, modified, or conducted in an altered format due to circumstances beyond the reasonable control of RunnerX LLP, including but not limited to natural disasters, adverse weather conditions, epidemics or pandemics, public health emergencies, governmental orders or restrictions, law enforcement actions, war, civil unrest, strikes, or any other unforeseen events (“Force Majeure Event”), and I further acknowledge that such events may occur before, during, or after the Event and may affect participation, safety, travel, or completion of the Event; accordingly, I agree that RunnerX LLP shall have full discretion to take any decision in such circumstances, including cancellation, postponement, route modification, or change of format, and I expressly waive any and all claims and agree that RunnerX LLP shall not be liable for any loss, injury, delay, expense, or inconvenience arising out of or in connection with any such Force Majeure Event or any decision taken pursuant thereto.
11. I consent to the collection, storage, processing, and sharing of personal information of me/my ward for purposes related to the Event, including operational, promotional, and communication purposes.
12. I acknowledge and agree that registration fees are non-refundable and non-transferable under any circumstances, except as may be expressly stated
in the applicable Terms and Conditions, and that no requests for cancellation, transfer, exchange, or modification of registration shall be entertained.
13. I grant full and irrevocable permission to RunnerX LLP to capture, use, reproduce, publish, and distribute photographs, videos, or recordings of me/my ward taken during the Event for promotional, commercial, and marketing purposes without any compensation.
14. I agree to receive information, updates, promotional communications, and offers relating to present and future events, services, partners, and associated activities of RunnerX LLP through electronic means including email, SMS, calls, WhatsApp, and other messaging platforms.
15. I acknowledge that any donation or contribution made by me is voluntary, non-refundable, and made at my sole discretion, including contributions made towards Deepti Welfare Foundation or any other partnered cause, and I understand that RunnerX LLP acts only as a facilitator and shall not be responsible for the utilisation of such funds; if a donation is made, I consent that my basic details, including name, contact number, email, and PAN (if applicable), may be shared with the respective organisation solely for issuance of donation receipt.
16. Where I register my ward or any other participant, I confirm that I am legally authorised to act on their behalf, and I accept full responsibility for their participation, including acceptance of all risks and all terms contained herein, and I further agree to indemnify and hold harmless RunnerX LLP against any claims arising from such registrations.
17. I confirm that I have read, fully understood, and voluntarily agreed to this Waiver, the applicable Terms and Conditions, and the Event rules and guidelines, and that I accept all such terms with full knowledge of their legal consequences, including the waiver of substantial legal rights.
VIRTUAL EVENT WAIVER
I, for myself and/or on behalf of my ward (where applicable), hereby declare, acknowledge, confirm and irrevocably agree as follows:
1. I confirm that participation in the Event in virtual format is entirely voluntary and undertaken independently by me/my ward without any supervision, control, or monitoring by RunnerX LLP.
2. I acknowledge that I/my ward shall select our own route, time, and conditions for participation and shall not use any official race route designated for on-ground events unless expressly permitted, and that such participation involves risks including but not limited to road hazards, traffic, environmental conditions, lack of medical support, and any unforeseen dangers, and I voluntarily accept full responsibility for all such risks.
3. I understand that submission of activity data, timing, or proof of participation must be accurate and genuine, and that any false, manipulated, or misleading submission may result in disqualification without any entitlement to certificate, medal, or recognition.
4. I fully understand and acknowledge that participation in the Event is an endurance and/or physical activity which involves inherent risks, including but not limited to serious physical injury, permanent disability, or death, and I voluntarily and unconditionally assume all such risks on behalf of myself and/or my ward.
5. I hereby irrevocably waive, release, discharge, and covenant not to sue RunnerX LLP, its partners, designated partners, directors, officers, employees, agents, sponsors, volunteers, event officials, venue owners, government authorities, and all other persons or entities associated directly or indirectly with the Event, from any and all claims, demands, liabilities, actions, causes of action, damages, losses, costs, or expenses of any nature whatsoever, whether arising in contract, tort (including negligence), strict liability, or otherwise, including but not limited to any injury, illness, disability, death, or loss of property suffered by me/my ward before, during, or after participation in the Event.
6. I confirm that I/my ward is medically fit and capable of undertaking the activity independently and that I assume full responsibility for health and safety.
7. I further agree to indemnify, defend, and hold harmless RunnerX LLP and all associated entities from and against any claims, liabilities, damages, costs, or expenses arising out of or in connection with participation by me/my ward or any breach of this Waiver.
8. I acknowledge and agree that the Event may be cancelled, postponed, or modified due to circumstances beyond the reasonable control of RunnerX LLP including but not limited to natural disasters, public health emergencies, or governmental restrictions, and I agree that RunnerX LLP shall not be liable for any consequences arising therefrom.
9. I acknowledge and agree that registration fees are non-refundable and non-transferable under any circumstances, except as may be expressly stated in the applicable Terms and Conditions, and that no requests for cancellation, transfer, exchange, or modification of registration shall be entertained.
10. I agree to receive information, updates, promotional communications, and offers relating to present and future events, services, partners, and associated activities of RunnerX LLP through electronic means including email, SMS, calls, WhatsApp, and other messaging platforms.
11. I consent to the collection, storage, and sharing of personal information of me/my ward with partners, service providers, or affiliated entities for purposes related to Event operations, verification, communication, and facilitation.
12. I acknowledge that any donation or contribution made by me is voluntary, non-refundable, and made at my sole discretion, including contributions made towards Deepti Welfare Foundation or any other partnered cause, and I
understand that RunnerX LLP acts only as a facilitator and shall not be responsible for the utilisation of such funds; if a donation is made, I consent that my basic details, including name, contact number, email, and PAN (if applicable), may be shared with the respective organisation solely for issuance of donation receipt.
13. 14. I confirm that I have read, fully understood, and voluntarily agreed to this Waiver, the applicable Terms and Conditions, and the Event rules and guidelines, and that I accept all such terms with full knowledge of their legal consequences, including the waiver of substantial legal rights.
